If I were a creative services director and had a chance to use some aerial footage in a news promo, I wouldn’t hesitate a minute. Slow, sweeping, rock-steady aerial views of any market add a majestic feel and can make even the smallest city or town look like a bustling metropolis.
And I wouldn’t care where I got the footage from — a news chopper with a gyro-mounted nose camera or a drone manned by a high school kid.

But apparently, according to a blogger in Milwaukee, using drone footage in a news promo can be an issue.
WISN, the Hearst-owned ABC affiliate in Milwaukee, used some aerial footage captured by a drone and the blogger questioned whether it was legal or not.
According to the blogger, Lauren Ridgley, WISN’s creative services director, said the station did hire and purchase footage shot from a drone by a local photographer.
“We did have conversations with our attorneys,” said Ridgley, “who informed us that the liability of the drone usage was on the photographer and his company.”
So for all you creative services directors out there who are wondering if you can use drone footage in your news promos if it’s purchased, the answer appears to be yes.
But please check with your lawyers first.
